WEFUNDED (PTY) LTD, registration number 2024/687966/07 (“WEFUNDED”, “we”, “us”, or “our”), provides access to simulated trading challenges, trader evaluations, assessment programs, and related educational, analytical, technological, and support services.

All services made available by WEFUNDED are provided in connection with a simulated trading environment using virtual funds, unless expressly stated otherwise in a separate written agreement.
‍
WEFUNDED does not provide investment services, does not provide investment advice, does not provide intermediary services, is not a broker, does not accept deposits, does not hold client funds, and does not execute trades on behalf of users in live financial markets.
‍
The information on this website, portal, dashboard, social media channels, email communications, support materials, promotional content, webinars, community channels, and any other material made available by WEFUNDED or its affiliates is provided for general informational purposes only. Nothing provided by WEFUNDED constitutes, or should be construed as:
‍
(a) investment advice;
‍(b) financial, legal, tax, or trading advice;
‍(c) an offer, invitation, or solicitation to buy or sell any financial instrument, security, derivative, or investment product;(d) portfolio management, advisory, dealing, brokerage, banking, custody, payment, exchange, or capital-raising services; or

Regulatory Status and Licensing

WEFUNDED provides simulated trading evaluation services only. WEFUNDED does not hold itself out as providing regulated financial services to the public merely by virtue of offering simulated trading challenges, assessments, or related services.
To the extent permitted by applicable law, WEFUNDED does not act as, and nothing on its website, platform, dashboard, communications, social media channels, or support materials shall be interpreted as WEFUNDED acting as, a licensed financial services provider, broker, dealer, investment adviser, portfolio manager, bank, custodian, payment institution, exchange, over-the-counter derivatives provider, or other regulated financial institution in any jurisdiction.
No part of WEFUNDED’s services, branding, terminology, account labels, dashboards, payout references, challenge structures, evaluation programs, educational content, or customer communications shall be construed as creating:

(a) a regulated client relationship;
‍(b) a brokerage relationship;
‍(c) an investment advisory relationship;
‍(d) a fiduciary relationship;
‍(e) an intermediary mandate; or
‍(f) any entitlement, protection, claim, or status under financial services, securities, banking, payments, or investment laws solely by reason of participation in WEFUNDED’s simulated trading services.

For the avoidance of doubt, no payment made to WEFUNDED is a deposit, investment, margin payment, custody balance, stored value, client money balance, or funds held for the purpose of live market participation. Any fees paid to WEFUNDED are paid solely as consideration for access to simulated trading evaluations, platform access, technology features, educational components, administrative review, and related services.

WEFUNDED makes no representation or warranty that its services are appropriate, available, permitted, or lawful in every jurisdiction. It is each user’s sole responsibility to ensure that their access to and use of WEFUNDED’s services is lawful in their jurisdiction and does not breach any applicable laws, licensing requirements, sanctions restrictions, exchange-control rules, tax obligations, consumer protection rules, or other legal requirements.

WEFUNDED reserves the right, at its sole discretion, to restrict, reject, suspend, terminate, or limit access to any user, account, country, territory, payment method, device, IP range, VPN or proxy source, or activity profile where WEFUNDED considers such action necessary or desirable for legal, regulatory, sanctions, fraud-prevention, compliance, operational, reputational, or risk-management reasons.

Simulated Trading Warning
‍
WEFUNDED’s challenges, evaluations, and funded-account style programs are designed to simulate market conditions using market data and platform technology. However, simulated trading is not the same as live trading and should not be relied upon as a basis for deciding whether, when, or how to trade with real capital.

While WEFUNDED’s simulated environment may seek to reflect aspects of real-market conditions, it is not identical to live trading and may not fully reflect the complexities, unpredictability, execution realities, and risks associated with trading real capital in live financial markets.
‍
There are material differences between simulated trading and live trading, including but not limited to:
‍
(a) liquidity differences;
‍(b) slippage and execution uncertainty;
‍(c) spread variation;
‍(d) latency and system interruptions;
‍(e) transactional costs and financing costs;
‍(f) market depth limitations;
‍(g) pricing disparities;
‍(h) broker-side execution factors;
‍(i) differences between quoted prices and dealable prices; and
‍(j) psychological and behavioral differences that arise when trading real capital.

As a result, simulated performance results do not reflect actual live trading results and may overstate or understate the impact of certain market factors.

General Trading Risk
‍
Trading in financial markets is inherently speculative and involves a high degree of risk. Even where a user performs well in a simulated environment, there is no guarantee that similar results can be achieved in live market conditions.
Market volatility, macroeconomic events, geopolitical developments, breaking news, reduced liquidity, pricing disruptions, market gaps, technology failures, and other external events may lead to rapid and substantial losses in live environments. WEFUNDED’s services are therefore not suitable for everyone, especially individuals with limited or no prior trading experience.

No Advice; No Recommendation

All content published or distributed by WEFUNDED and its affiliates is provided for general informational purposes only. WEFUNDED does not recommend that any person engage in any live trading activity, use any particular strategy, copy any trading style, use any particular broker, or trade any specific asset class, instrument, or market.
Any information, education, examples, analysis, market commentary, webinars, tutorials, account metrics, or support communications made available by WEFUNDED are provided solely for general educational or operational purposes and must not be relied upon as financial, investment, legal, tax, or other professional advice.

No Guarantee of Funding, Payout, or Continued Access

Participation in any WEFUNDED challenge, assessment, evaluation, or funded-account style program does not create any right, claim, or entitlement to receive a funded account, simulated capital allocation, payout, refund, compensation, or continued access to the platform.

All such outcomes remain subject to WEFUNDED’s rules, verification procedures, fraud reviews, compliance checks, jurisdictional eligibility, risk-management protocols, technical validation, identity verification, payment screening, and discretionary determinations made in good faith for the protection of platform integrity and business risk.

WEFUNDED reserves the right to withhold, delay, deny, adjust, reverse, cancel, suspend, or void any challenge result, funded status, payout request, refund request, account access, or related benefit where WEFUNDED reasonably believes that a breach of its rules, abuse of its systems, misconduct, fraud, suspicious activity, prohibited conduct, legal risk, sanctions issue, identity concern, technical manipulation, unfair advantage, or other integrity concern may exist.

Third-Party Providers and Technical Risk

WEFUNDED may rely on third-party service providers for trading platforms, market data, charting, payment processing, identity verification, fraud screening, analytics, hosting, email delivery, communications, customer support, and related infrastructure.
‍
WEFUNDED does not warrant that any website, dashboard, technology, simulated trading platform, third-party integration, or related service will be uninterrupted, error-free, secure, accurate, complete, timely, continuously available, or fit for any particular purpose.
‍
WEFUNDED shall not be responsible for any interruption, outage, delay, pricing issue, feed discrepancy, latency issue, account sync error, technical malfunction, force majeure event, cyber event, infrastructure issue, data loss, or third-party failure affecting access to its services or the operation of any evaluation or simulated account.

Jurisdictional Restrictions

WEFUNDED makes no representation or warranty that its website, services, platform, challenges, programs, materials, or communications are appropriate, lawful, or available for use in every jurisdiction.
‍
Access to or use of WEFUNDED’s services may be restricted or prohibited in certain countries, territories, or regions where such access or use would violate applicable laws, regulations, sanctions regimes, licensing requirements, financial promotion rules, platform restrictions, or other legal requirements.
‍
It is your responsibility to ensure that your access to and use of WEFUNDED’s services is lawful in your jurisdiction and compliant with all laws, regulations, sanctions, tax obligations, and compliance requirements applicable to you.

Assumption of Risk

By accessing or using WEFUNDED’s website, platform, challenges, evaluations, dashboards, or related services, you acknowledge and agree that:

(a) you understand that WEFUNDED operates a simulated trading model;
‍(b) you understand that simulated trading differs materially from live trading;
‍(c) you understand that no information provided by WEFUNDED constitutes financial advice or a regulated financial service;
‍(d) you participate entirely at your own risk; and
‍(e) you are solely responsible for ensuring that your use of the services is lawful and appropriate in your jurisdiction.

Limitation of Liability
‍
Without limiting any other rights under WEFUNDED’s Terms and Conditions, WEFUNDED shall not be liable for any direct, indirect, incidental, special, punitive, exemplary, or consequential loss, damage, cost, claim, or liability arising from or related to:
‍
(a) use of or inability to use WEFUNDED’s services;
‍(b) reliance on any information made available by WEFUNDED;
‍(c) any user’s trading decisions, strategies, or conduct;
‍(d) technical failures, outages, delays, pricing issues, feed errors, or platform interruptions;
‍(e) third-party service disruptions or failures;
‍(f) challenge failure, account breach, disqualification, suspension, termination, denial of payout, cancellation of services, or voiding of results in accordance with WEFUNDED’s rules;
‍(g) unauthorized access, cybersecurity events, fraud, abuse, VPN or proxy masking, geo-bypass conduct, device masking, payment irregularities, identity concerns, or compliance-related restrictions; or
‍(h) any legal, regulatory, sanctions, tax, or jurisdictional consequence arising from a user’s access to or use of the services.

Acceptance
‍
All users remain solely responsible for understanding the risks associated with trading and simulated trading evaluations.
